I came across the following arcticle for adult webmasters, and I thought I’d share it with you. It’s very informative and straight forward. I have already checked them all out, and even signed up with one of them and waiting to hear back from a second one about my adult content delivery.The only company I was not able to check out is grsoft.net because the site is currently not available. Lexxxi Lockhart shooting for Brazzers

Hey Perves,

I apologize in the delayed update, but please dont be mad.
We wanted to make sure that everything was confirmed and in order… so without further ado, the great news.

Lexxxi Lockhart will be traveling to LA tomorow to do a shoot with Brazzers. The shoot will be one day on Wednsday, and she’s flying back home on Thursday. We are all very excited at the incredible speed that Lexxxi’s popularity is growing in such a short time.  Word is, that she will be shooting with Brazzer’s contract male talent keiran Lee. Now don’t worry, as promised, Lexxxi’s site will still be 100% fan based interaction, there will be no deviation from that. Lexxxi loves her fans, so she’s dedicating her members site to those fan that show her support by fucking as many of them as she can on screen. With the exeption of me being in one, maybe two scenes for her site, the rest of the scenes will be ONLY the fans. Not that I’m not a fan of Lexxi, cause I really am. This is for the fans out there and their fantasy of being in a movie with her.

She will be here for only 2 of the 3 days of the expo, leaving little if any time to shoot with her fans..

So that’s the Lexxi news for now. I have some other great news of my own, but for a different blog entry, I don’t want to overload everybody with great news. LOL.

FSC to Hold 2257 Third-party Record-keeping Forum

CANOGA PARK, Calif. – The Free Speech Coalition will moderate a forum Feb. 12 to discuss the potential development of recommendations for 2257 third-party record-keepers.

The forum will be held on the last day of the XBiz conference, from 1-3 p.m. in the Hidden Hills room in the Marriott, Woodland Hills.

FSC invites adult industry professionals who are interested and impacted by the 2257 final regulations and third-party record-keeping revision to attend.

“Every time there is a development in 2257, be it rules and regulations or court cases, we receive a number of calls,” said FSC Executive Director Diane Duke. “Third-party record keeping represents a significant change and we thought it beneficial to consider the development of recommendations to help industry professionals navigate these revised regulations.”

Workers Comp Insurer Changes Rules for Talent Agents

LOS ANGELES — Adult entertainment talent agents who are insured by State Compensation Insurance Fund and send performers to production sets of uninsured studios might be in for a shock if the porn star gets injured — they could be on the hook for a workers compensation claim.

State Fund, which manages the bulk of employers’ workers comp insurance in California, has changed its policy over workplace responsibility when adult entertainment agents book talent with uninsured production companies, according to adult industry attorney Michael Fattorosi, www.adultbizlaw.com [pictured].

Fattorosi told XBIZ that he had a half-hour long conversation with a State Fund underwriter Tuesday that revealed a bombshell over liability when he asked a question involving a new Porn Valley talent agent Fattorosi represents.

“State Fund told me that they feel there is a problem in the adult entertainment industry over injuries suffered on the set, and that someone has got to cover the performers,” Fattorosi said. “They are basically saying that the adult industry needs to police itself in regards to workers compensation insurance.

“It appears that they are taking the position that if an agent does not check whether a production company is insured, that agent can ultimately be responsible for benefits if that performer suffers an injury on set. This is a radical departure since it has been commonly believed that performers were not employees of the talent agencies.”

Fattorosi said that in order for agents based in California to be “legal,” they must be licensed and bonded by the state of California, as well as covered under a workers comp insurance policy.

According to the Labor Code, every employer in the state of California must carry workers compensation insurance. Failure to do so is a criminal offense.

For adult performers, workplace injuries run the gamut, from simple trip-and-falls to contraction of STDs, including HIV infection.

In the past, Cal-OSHA has conducted periodic spot checks on the set over workers comp insurance, and the state’s Department of Industrial Relations can shut down a porn set and could fine the company $1,000 per day, per performer, until it can prove it has workers comp policies.

XBIZ was unable to obtain comment from State Fund chief public information officer Patrick Anderson over apparent changes to the insurer’s policies, but Fattorosi said that its new rule could spread to other workers comp insurance companies that insure employers, including production companies and talent agents within the state.

“I’d expect all of them to adopt this rule,” Fattorosi said. State Fund can also assess fines and or penalties against their insureds that under report payroll. They are now expecting agents to report the earnings the performers make as a part of their payroll so SCIF can adjust insurance premiums for those agents.

“Ultimately I can see this costing the agents a lot of money in premium dollars,” Fattorosi added.

Report: Mobile Porn Going Into the Tub

Sex sells, but in these times of financial crisis, it sells considerably less. The global economic downturn has had a broad impact and now has struck the mobile porn industry as well. A report by Juniper Research predicts that the adult mobile content market will grow 3.5 per cent less than previously expected.

X-rated content is often perceived as a huge revenue generator due to the success of its online cousin, however usage levels have fallen, bringing the overall revenue forecast to $2.2 billion this year, says Juniper.

The research found that despite there being a ‘comparatively small number of consumers’ utilising adult mobile services, these subscribers have a higher spend level than your average mobile user– with some splashing out several hundred dollars each year on video chats.

“While in some instances usage levels are marginally lower than we expected, we are actually seeing significantly higher spend per user on video chat and on some subscription-based services,” said Dr Windsor Holden, author of the report.

Currently, there is a plethora of X-rated content available on mobile phones ranging from wallpapers and screensavers to videos and SMS services. But Juniper predicts that interactive video chat services will become the largest contributors of the mobile adult content market over the next five years, passing the $1 billion mark by 2011.

The UK-based firm also noted that adult content usage on mobile phones varies regionally. For instance, Indonesia and Switzerland have recently tightened the laws governing access to adult content, while operators in the US still remain wary and often distance themselves from offering such content on their portals.

Meanwhile, over in Europe and parts of Latin America, adult content on operator portals, managed by third-parties, is becoming far more prevalent, the report observed.

Highlights of The New 2257 Regs

For the most part, the better part of the weekend was spent reading the new regs that apply to 18 USC 2257. The regs – 28 CFR 75 is a rather long read. There is a lot of useful and necessary information for the content producer and webmaster alike. If you have not read the regs, please do so immediately. I realize a lot of my clients want a basic general overview, but if you do not read the regs yourself, it will be difficult to explain the changes. 18 USC 2257 will be a topic that will be covered in depth not only on AdultBizLaw.com but on every other website and forum in the industry. Be careful who you listen to in regards to the regs.

Some note worthy changes/clarifications…

(1) third party custody is now allowed
(2) foreign ids are okay if a US company is shooting in a foreign country, if the talent is foreign BUT if the talent is US living in a foreign country they still need their US ID.
(3) cannot shoot foreign talent in the US unless they have US ID and are legal to work here.
(4) social networking sites do not have to keep record UNLESS …. and theres a catch
(5) secondary producers MUST keep records, linking to primary producers is not enough.
(6) a link/compliance statement on every page is necessary…

There are more changes than just what is listed. If you have even simulated sex on your site, you may have to keep records. The regs take effect in March so my advice is to read them yourself and if needed, have one of the adult industry lawyers explain it as well. I see them starting inspections again after these take effect.

CHATSWORTH, Calif. – Hardcore content provider Red Light Revenue has teamed up with submission-software company DreamSubmitter to offer Red Light Revenue affiliates free copies of DreamSubmitter 3.0.
